'Nonsense': Ex-prosecutor explains Judge Cannon's next step in Trump classified docs case



Donald Trump's lawyers filed a request for Judge Aileen Cannon in Florida, asking her to issue a stay of the documents case pending her review of whether the new Supreme Court immunity ruling will save him.

Speaking to MSNBC about the filing, former state and federal prosecutor Glenn Kirschner said that Cannon's next steps are to hold an evidentiary hearing to decide whether the evidence in the case falls under Trump's time in the White House.

Trump is charged with 37 counts about the theft of documents from the White House to Mar-a-Lago upon leaving the presidency. Some of the charges include obstruction of justice.

"Of course, Donald Trump's lawyers have now briefed up that issue or at least are asking Judge Cannon to allow them to brief up that issue," Kirschner said about the new immunity ruling from the court.

"Now, admittedly, Judge Cannon will have to hold some evidentiary hearings to determine whether some of the acts, some of the conduct by Donald Trump while still president," Kirschner explained.

While it isn't likely that Trump's federal cases will move forward before the election, the evidentiary hearings will give Americans the opportunity to hear the case against Trump publicly. Analysts said that after the Supreme Court's decision, the 2020 election case under Judge Tanya Chutkan should be held in such a hearing.

Here, Kirschner said, that such a hearing is certainly the next step that prosecutors could take.

Cannon would then decide "when he basically collected up — and let's call it what it was — stole from the federal government classified documents, whether any of that should enjoy any level of presidential immunity, either absolute or presumptive. We knew there would be legal issues that would have to be litigated in Florida. But when you read this 20-plus page filing by Donald Trump, it not surprisingly reads like yet another extended Trump post with all sorts of nonsense thrown in the mix."
