Albany man sentenced 7 years in sex abuse case

An Albany man was sentenced to seven years in state prison and 15 years of probation for sexual abuse on Friday.

ALBANY, N.Y. (NEWS10)-- An Albany man was sentenced to seven years in state prison and 15 years of probation for sexual abuse on Friday. Court officials said Carl Barton, 58, will fulfill his sentence consecutively to a 30-year to life sentence for two prior felonies.

Barton was found guilty in April of engaging in sexual contact with a person unable to give consent because of a mental disability. He was indicted in November 2020 and convicted in April 2024 for second-degree criminal sexual abuse following a jury trial.

Barton's two prior felony convictions he is already serving are 25 years to life for predatory sexual assault and five years for attempted criminal possession of a controlled substance. Barton was sentenced by Judge Roger McDonough, who said Barton had shown himself throughout his life to be a sexual predator.

"In the most diabolical way he is a predator, which is, he preys on individuals who are incapable of defending themselves," McDonough said. "He is clearly an individual who cannot function in society without attempting to, or actually preying on other members of society."
