Group says lawsuit over San Marcos' marijuana ordinance dismissed

A district court judge for Hays County dismissed a lawsuit over a marijuana ordinance in San Marcos, according to a news release from Ground Game Texas.

SAN MARCOS, Texas (KXAN) -- A district court judge for Hays County dismissed a lawsuit over a marijuana ordinance in San Marcos, according to a news release from Ground Game Texas.

Back in 2022, voters in San Marcos voted to decriminalize marijuana. Local advocacy group Mano Amiga collected enough petition signatures to get the issue to the San Marcos City Council.

Furthermore, in 2022 Ground Game Texas partnered with Manos Amiga to collect more than 11,000 signatures to support decriminalizing marijuana in San Marcos, the release said.

"This decision, along with the recent verification of our petition in Dallas, is a welcome reminder that this is a winning movement, and one we look forward to continuing to build across the state this November with the collaboration of partners like Mano Amiga," Catina Voellinger, Executive Director of Ground Game Texas, said in the release.

Just last month, a Travis County judge dismissed a lawsuit from Paxton over an Austin marijuana ordinance.

In 2022, voters in the City of Austin passed Proposition A, which effectively decriminalized low-level possession of marijuana. Ground Game Texas led that effort.

San Marcos was one of five Texas cities Paxton targeted, along with Austin, Killeen, Elgin and Denton.
