'Most legal scholars disagree': CNN host fact-checks Trump's lawyer to his face



Donald Trump's attorney, Will Scharf, was fact-checked to his face by CNN Friday after claiming that special counsel Jack Smith was illegally tasked with going after the ex-president.

Florida Judge Aileen Cannon dismissed Trump's classified documents case after his lawyers claimed Smith's appointment was unconstitutional. Smith notified the 11th Circuit Court of Appeals that he intends to file a challenge to the motion to dismiss.

In an interview this week with Merrick Garland, the attorney general said correctly that "until now, every single court, including the Supreme Court, that it has considered the legality of special counsel appointment has upheld it."

Scharf claimed that the Supreme Court hadn't given much guidance on the matter of the legality of the special counsel, going on to quote far-right Justice Clarence Thomas.

In the Trump immunity case, Thomas wrote his own concurrence that no other justice signed onto. When talking about presidential immunity, Thomas walked through the classified documents case, saying that the case should be dismissed. Cannon followed the comments, citing him at least three times in her ruling.

"So, I don't think cannon is that far out there," claimed Scharf, calling her ruling "well reasoned."

The claim the Trump team has used to try to get rid of Smith failed at the Washington, D.C. court, and when Hunter Biden tried something similar, his complaint was dismissed, too.

Scharf said he thinks it will be upheld on appeal.

"Most legal scholars disagree with your assessment of Cannon's case," CNN's Paula Reid shot back.

The Trump lawyer claimed that the warrants from the New York case will likely be overturned there and as such the verdict can be overturned.

Scharf urged Manhattan District Attorney Alvin Bragg to return to square one with the grand jury.
