Family of fatal crash victim suing Colonie for negligence
ALBANY, N.Y. (NEWS10) -- The family of a victim in a deadly crash in May 2023 is suing the town of Colonie, according to a report in The Times Union. The family has accused the town of negligence.
The family of 17-year-old Michael Kleinke claim police allowed Thomas McGrath, the driver accused of killing their son, to leave a separate crash an hour prior to the fatal collision on Route 85. The family also said it was his third accident in only a few days.
McGrath pleaded not guilty to seven charges, including manslaughter in the second degree, assault in the second degree, aggravated vehicular manslaughter, driving while ability impaired by the combined influence of drugs, two counts of reckless driving, and reckless endangerment in the second degree.
