Judge Chutkan sets schedule in Trump trial — potentially setting up release of evidence

Federal Judge Tanya Chutkan has set a schedule that includes inviting special counsel Jack Smith to provide a comprehensive brief on the evidence that former President Donald Trump acted outside the scope of his official duties in the plot to overturn the election, reported MSNBC legal analyst Lisa Rubin.

Chutkan has requested the brief be submitted by Sept. 28. Once submitted, that could clear the way for Chutkan to make some or all of that evidence public.

It dealt a blow to Trump's attorneys, who wanted to handle these issues around whether Trump has presidential immunity from prosecution after the election, for fear some of this evidence would be damning to voters.

Chutkan made clear in her conference that she would not decide on the matter based on its effect on Trump's political campaign.
