Texas doctor loses medical license in Kansas after $1.4 million Medicare fraud scheme

TOPEKA (KSNT) - Kansas health officials revoked the license of a telemedicine doctor following his conviction in a Medicare scheme.

The Kansas State Board of Healing Arts (KSHBA) released a final order on Tuesday, Sept. 17 in the case of Rodney Sosa, a Texas chiropractor practicing telemedicine in Kansas. In June 2023, Sosa was convicted in a United States District Court based out of Dallas for one count of conspiracy to defraud the United States and to make materially false statements and was sentenced to 46 months, or almost 4 years, in prison.

Sosa's conviction stemmed from accusations he signed prescriptions and other Medicare-required documents for certain tests and medical devices which were not legitimately prescribed, unnecessary, not used or were induced through unlawful kickbacks and bribes, according to court records with the U.S. Department of Justice (DOJ).

Sosa, and two other co-conspirators, were accused of unlawfully submitting and causing to be submitted $1.4 million in false and fraudulent claims to federal health care programs, like Medicare, for prescriptions for genetic tests and durable medical equipment. Medicare paid out $574,000 on the false and fraudulent claims from Sosa and his co-conspirators.

The KSHBA ordered Sosa's license to practice telemedicine in Kansas to be revoked following his conviction. This decision was made as the board did not receive any evidence that Sosa will not pose a threat to the public as a chiropractor practicing telemedicine in Kansas and that he has not been rehabilitated to warrant the public trust. All medical records kept by Sosa are to be turned over to another licensed practitioner of medicine and surgery or a records maintenance facility.
