Any legal eagles that can advise? (3 replies)

In 2002, my mom and stepfather (Jim) were living in a Council house. Under the Right to Buy, we (3 of 4 sisters plus a cousin) paid for the house purchase and a solicitor put in place a Certificate of Trust in our names but, naturally, the house was still in mom & Jim’s names.

Jim died in 2002, didn’t leave a will, was not in touch with his sons etc so his estate went to mom. But none of us thought to have his name removed from the joint tenancy ????‍♀️

As most of you know, my mom died recently, again without a will ???? (despite me keep saying you need to do a will!!)

So I’ve just applied for Probate and have the Letters of Administration. The stumbling block is that Jim’s name is still on the house deeds

I’m aware it would have had to have been the surviving joint tenant that did it - but that surviving joint tenant is also now deceased.

Is there a way of us removing his name now?
