Man charged in fatal Albany dog mauling heading to court
ALBANY, N.Y. (NEWS10) -44-year-old Omar Daniels was arrested in connection to up to nine dogs who attacked and killed 60-year-old James Provost. The mauling happened in the yard behind 594 Central Avenue on the evening of October 9.
Once on the scene, Albany Police worked to stop the attack. An officer fired his gun which killed one dog but Provost was pronounced dead.
Daniels has been charged with six counts since his indictment last Friday, including:
- Manslaughter in the second degree
- Criminally negligent homicide
- Aggravated cruelty to animals
- Three separate counts of overdriving, torturing and injuring animals; failure to provide proper sustenance
Daniels pleaded not guilty and is being held by DOCCS without bail on a previous drug charge.
He was set to be in Albany County Court on Monday, January 6, for a separate attempted criminal possession of a weapon charge. That appearance was postponed but Daniels will be in court on February 7 for the dog mauling case.
On top of the eight surviving dogs, fifteen others, all owned by the same woman, were seized as part of this investigation. They are all in the care of the Mohawk Hudson Humane Society. A spokesperson told NEWS10's Anthony Krolikowski that decisions on the dogs are made by the District Attorney’s Office.
It’s still unclear why the dogs attacked Provost. Albany Police said the nine dogs involved were originally in the next-door yard.
