The woman took her plea to the Social Court of Alicante. However, the court dismissed her plea. Instead, a court hearing revealed that she had received multiple warnings in the past in both written and verbal form to report at the required time. The company reported that she had no work to be performed by reporting early to the office and how it disrupted the internal coordination of the team. Another unusual revelation was that the 22-year-old woman had tried to log into the company’s app 19 times before even arriving at the office’s premises.
The boss stated that her behaviour came as ‘disloyalty’ and that the decision of her termination was primarily because of denying to follow the company’s rules and regulations. In the statement, the court mentioned that the woman’s behaviour in the office is a direct violation of Article 54 of the Spanish Workers’ Statute.
