10 percent service fee cancellation: Ministry of Trade clarifies new rules

Tengrinews.kz - Deputy Chairman-Commissioner of the Consumer Protection Committee of the Ministry of Trade and Integration, Bulat Tanabergenov, addressed questions regarding the proposed cancellation of the 10 percent service fee in Kazakhstan’s catering establishments.
"In Parliament, a draft law on consumer protection is under consideration. It was reported that there is a proposal to cancel the 10 percent service fee in catering establishments. However, this provision is not included in the draft law. Where did it come from, who initiated it, and will it be added to the document, and how does it work in practice?" Tanabergenov was asked at a CCS briefing.
According to Tanabergenov, the rule regarding the 10 percent service fee must be indicated in the menu.

"In accordance with the Civil Code, a menu is considered a public offer, and any additional service charges must be clearly stated within it. Changes to internal trade regulations now stipulate that charging a 10 percent service fee is legal only if it is explicitly mentioned in the menu," Tanabergenov explained.

This comes after Minister of Trade and Integration Arman Shakkaliyev held discussions in September with representatives from "Atameken", public organizations in retail and catering, and business owners to address improvements in the catering service sector.
