Urinating student’s case postponed again

The UCT student who allegedly urinated on the head of Michelle Nomgcan appeared in court before the case was postponed.

Cape Town - The UCT student who allegedly urinated on the head of taxi driver Michelle Nomgcana in January last year, appeared in the Wynberg Magistrate’s Court on Friday, before the case was postponed.

Ilse Taylor, for Djavan Arrigone, said the defence and state had agreed to continue the case on October 23.

It is expected that on that day a further date will be set for the case to continue.

Arrigone, in a dark blue suit and a white shirt, left the court immediately after magistrate Siviwe Yaki agreed to the postponement.

He is out on a warning.

Nomgcana, from Khayelitsha, who was in court on Friday, told Weekend Argus he hoped this would be the last postponement.

He was wearing a black T-shirt that read “Justice Against Racism Issues. Stop Racism”.

Arrigone has been charged with crimen injuria after he urinated from the balcony of the Tiger Tiger nightclub in Claremont early on January 24 during a night of drinking.

When he finished, he went back inside to dance.

The urine landed on Nomgcana, who at the time was working as a taxi driver and waiting for customers on the street below.

In previous court appearances, Arrigone admitted relieving himself from the balcony, but denied aiming at Nomgcana, saying he couldn't see who was below him.

In February he told the court that he was drunk after drinking vodka, tequila, white wine and whisky over four hours.

“At the time my attention was fixated on two friends standing next to me. They were both laughing at me. They thought I was being funny.”

Nomgcana said his dignity was impaired by the incident.

He has also alleged that Arrigone made racist remarks after he alerted the club’s bouncer and entered the establishment to confront the student and his friends.

Arrigone has denied this.
