Johannesburg – The Constitutional Court on Friday upheld the High Court ruling that calling security services into Parliament was unconstitutional.

The Speaker of the National Assembly, Baleka Mbete, has asked the Constitutional Court to consider a possible 12-month suspension of an order against the law she used to remove EFF MPs from Parliament, if found to be inconsistent with the constitution.

Mbete made the plea in her written submission to the court against an application brought by the DA to declare section 11 of the Powers, Privileges and Immunities of Parliament and Provincial Legislatures Act unconstitutional.

At the State of the Nation Address in February, Mbete invoked the act to call police and parliamentary protection officers to remove EFF MPs from the National Assembly.

The DA initially approached the Western Cape High Court in March to challenge the constitutionality of the law, stating that it clashed with section 58 of the constitution.
