New Mexico judge Mary Marlowe Sommer rejected the arguments to dismiss the case by the actor’s lawyers, according to Variety.

If convicted, Alec could face up to 18 months in prison. He is being accused of “negligently pointing his gun at Hutchins and pulling the trigger while preparing to film a scene, and has also been faulted for contributing to lax safety standards on set.”

The charges were initially dropped in April 2023. However, the dismissal was called into question after a bombshell gun analysis called some details into question.

After the ruling that the case would not be dismissed, Alec‘s lawyers issued a brief statement, saying, “We look forward to our day in court.”

Alec has denied pulling the trigger and denied that it was his responsibility to ensure the gun was safe.

In April, the on-set armorer, Hannah Gutierrez-Reid, received her sentencing for involuntary manslaughter in the fatal shooting.
