But after being acquitted of criminally negligent homicide, Daniel Penny tells Fox News he couldn’t have lived with himself if he hadn’t acted. The network aired clips of Penny's interview Tuesday, a day after a Manhattan jury decided the case surrounding Jordan Neely's death. Scores of New Yorkers protested the trial outcome Tuesday evening. Penny put Neely in a chokehold for about six minutes after Neely had an outburst that frightened riders on a subway car.
