GSP coming back and USADA rules: should he be tested now?
With the Brock Lesnar situation, where he was "exempted" from the 4 months rule when coming back from retirement purely for marketing reasons, why would GSP not be tested at all since his hiatus?
GSP was not retired, but was he according to USADA? He still has a contractual relationship with the UFC. In either case, he either should of been tested since the USADA rules were implemented or be tested right now, since he is officially "unretired".
This highlights the problem with this 4 month rule : it is incredibly murky. If for whatever reason GSP wanted to work with the UFC and make it a surprise comeback, USADA would have no power to test him prior to it.
The original goal of that 4 month rule was to avoid having fighters retire and unretire from fighting to duck testing. However, the real goal is avoid having fighter duck testing, period. People always bring up the short notice fight example, where a new fighter for instance gets a chance to fight in the UFC on short notice. That is vastly different, as the athlete has no control over when he can fight. That would be indeed unfair for the athlete to not get his shot in the UFC. In a unretirement case, the Athlete and the UFC have no non-marketing/non-financial reason to book a fight that early, no matter who it is. They won't suddenly not accept a fighter un-retiring because he can't fill that particular card, and sure, there could be exceptions where that would make sense (a very local attraction).
This isn't really about GSP being on PED or not here, it's more about the procedure for testing that makes no sense. It should be set in stone that if you make a comeback, you need to be available for testing at least 4 months before the fight. The comeback fight cannot happen less than 4 months before it is announced/booked. No exceptions. There was nothing "unfair" for the Athlete in the Brock Lesnar case, and letting the promoter decide what is unfair and what is fair is a blatant conflict of interest.
You have to respect the integrity of testing fighters for PED, which is a rampant image problem for the sport. We are not watching grown adults kicking or throwing balls at a net here. The testing procedure should be way more solid than any regular sports.
